This agreement (“Agreement”) is between you (the “Trial User”) and MOSA Innovations Limited, a company registered in England and Wales (registration 13358119), with its registered office at 5-7 Buck Street, London, NW1 8NJ (“MOSA”, “we”, or “us”). By agreeing to become a trial user for MOSA’s Olympic Park/Westfield trial, you accept all the terms and conditions outlined in this Agreement. Please only join if you have read and accepted these terms.
GENERAL TERMS & CONDITIONS
1. Trial Participation and Compliance
You agree to comply with the rules of the trial (the “Rules”) regarding the use of our services and your conduct. The trial will take place at Queen Elizabeth Olympic Park and Westfield Shopping Centre from 15 August 2023 until the announced end date.
2. Assignment
We may assign the benefits and rights of this Agreement to a third party with notice to you. Your rights under this Agreement will not be prejudiced by such an assignment.
3. Voluntary Participation
Your participation in this trial is voluntary, with no monetary compensation. We also do not charge any fees for the use of our services during the trial.
4. Termination of Participation
You may terminate your participation in the trial at any time by providing one day’s notice in writing via email to hello@mosa.to.
5. Conduct and Liability
If we or our operational partners have reasonable grounds to believe that you intend to misuse our services or smart locks, or attempt to damage our technology, we may hold you responsible for your conduct and liable for any losses incurred by us or our partners as a result. We reserve the right to terminate your participation in the trial.
6. Availability
We do not guarantee the availability of our smart locks, especially during peak hours.
7. Force Majeure
We will not be liable for any failure to perform, or delay in performance of, any of our obligations under this Agreement caused by events outside our reasonable control.
8. Liability for Loss, Damage, or Theft
MOSA Innovations Ltd, its agents, employees, and subcontractors are not liable for any loss, damage, or theft of your property brought onto any premises. If such loss, damage, or theft is directly caused by the failure of our lock technology or by negligent acts or omissions by MOSA Innovations Ltd, its agents, employees, or subcontractors, with supporting evidence, our liability to you will be limited to £1000.
9. Operational Hours
The operational hours for our smart lock trial are from 7:00 AM to 11:00 PM. We are not liable for any damage or theft caused by the failure of our lock technology outside these hours.
10. Privacy and Data Protection
At MOSA, we are committed to protecting your privacy. You agree that we can collect and process personal data about you to provide our services, operate the trial, and protect the security of our systems and customers. All personal information and feedback you provide will not be shared with any third party.
11. Governing Law
This Agreement is governed by the laws of England and Wales.
